Recruiting Expert Witnesses
The Board of Optometry Enforcement Program is seeking qualified optometrists with the professional and educational background required to review case materials, prepare written reports and possibly testify at administrative hearings as an Expert Witness on behalf of the Board. An Expert Witness is any person possessing technical or professional knowledge from advanced education and/or extensive work experience enabling the formation of definite opinions in an area of expertise.
Expert witness reports and/or findings may result in a disciplinary action of an optometrist. Enforcement Program cases include, but are not limited to, the following subject areas:
- Departure from Standard of Care
- Substance Abuse
- Insurance Fraud
- Sexual Misconduct
Experts must possess knowledge and skill consistent with current community standards of care and shall act accordingly. The Board pays experts at the rate of $100.00 an hour for review and preparation of a written report and $150.00 an hour for testimony at a hearing.
Expert Witnesses must meet the following requirements:
- A current and active California Optometric License
- Five or more years of experience and expertise in one of the areas listed above AND current employment in that setting.
- No prior or current charges or discipline against any health care related license in California or in any other place of licensure.
- No criminal convictions, including any that were expunged or dismissed.
